Rental Agreement
This agreement sets forth the terms of the Rental Agreement between Julie Traina (“Owner or We”), and the person named in the associated Vacation Rental Summary Invoice (“Renter or You”). Owner agrees to rent to Renter the Q Street Cottage on Avenue Q, Galveston, Texas 77550 ( “rental property”), under the following conditions:
1. Term: This agreement shall commence at 3:00 p.m. and terminate at noon on the dates set forth in the associated Vacation Rental Summary Invoice. If You overstay the Check-Out time of Noon, You will be charged an additional night of rent.
2. Check-In and Check-Out: We will try to accommodate You and your guests but cannot guarantee early Check-In or late Check-Out requests. Check-In for the property will be at 1721 Broadway, Galveston Texas, between 3:00 p.m.- 5:00 p.m. At Check-In, Renter will be given all pertinent information and keys to the rental property. If a later check-in is needed, please make arrangements with Owner at least one week before You are due to arrive. Check-Out is at noon.
3. Reservation and Payment Schedule: Payment of the security/damage deposit, cleaning fee, taxes and 50% of rental fees will be required together with this accepted by Renter rental agreement to hold the rental property for the dates requested in your reservation request. The remaining unpaid amounts, if any, are due at Check-In. If there are less than 7 days until Check-In, then all amounts must be paid to book the rental property.
4. Cancellations and Refunds: All Cancellations must be made by email to Julie@qutiepi.com . If the cancellation is made 30 days or more before your scheduled arrival, a cancellation fee of $100 will be retained from any refunds. If the cancellation is made 30 to 7 days before your scheduled arrival, a cancellation fee of 50% of all prepayments will be retained from any refunds. If the cancellation is less than 7 days before scheduled arrival, all prepayments are forfeited and NO REFUNDS are made. There are NO REFUNDS FOR EARLY DEPARTURES. Since unforeseen circumstances can occur before your arrival or when You are away from home, We strongly recommend Vacation Rental Insurance.
5. Renter Restrictions: You must be 25 and the person who is the Renter must occupy the rental property the entire length of the rental period.
6. Maximum Occupancy: No more than 6 adults may occupy the rental property overnight.
7. Parking: We are not responsible for vehicles while being parked at the property. A maximum number of two (2) vehicles will permitted to park in the rental property’s driveway. Although there is additional street parking, it is your responsibility to find additional parking for additional vehicles.
8. Rental Agreement Approval and Required Payments: A reservation request will be cancelled unless:
a. Renter agrees to Rental Agreement via email to Julie@qutiepi.com within two days after Owner sends the Renter rental package to You for approved rental dates via email; and
b. Invoiced amounts must be paid via check, credit card or PayPal in accordance with invoice emailed to Renter.
Rental is not confirmed until a confirmation email by Owner is sent to Renter.
9. Smoking, Fishing and Pets:
a. Smoking is not allowed inside rental property.
b. The cleaning of fish/crabs/oysters etc. must be done OUTSIDE only and on newspaper or trash bags. All discarded parts of fish/crabs/oysters etc. must be separately bagged in plastic trash bags and placed in outside trash receptacle.
c. Written Owner approval is required for pets along with an additional $100 non-refundable pet deposit. Violators must remove any animal or vacant. No refunds are given. Renter will also be charged additional cleaning fees, plus one night rental charge for loss of income due to down time.
10. Damages. Renter will be charged for any damages to rental property or items of personal property taken from rental property. Renter specifically approves and agrees that any damages will be charged to the Renter’s credit card pursuant to credit card information provided to Owner and Renter specifically authorizes Owner to process or charge such amounts to such credit card account.
11. Hand Over: Renter shall deliver possession of residence in good order and repair to Owner upon termination or expiration of the rental.
12. Subletting: Renter may not sublet rental property or assign this rental agreement.
13. Right of Access: Owner shall have the right of access to rental property for repair and maintenance during reasonable hours. Owner may enter rental property at any time to protect life and/or to prevent damage to the property.
14. Use of Property: Renter shall comply with state, county, and municipal laws and ordinances concerning use of rental property. Renter shall not use rental or permit it to be used for any disorderly or unlawful purpose or in any manner so as to interfere with the quiet enjoyment of neighboring properties. Renter shall not allow loud noises or music on rental property between 10 p.m. and 8 a.m. Any misuse described above shall result in immediate termination of Rental Agreement and no refund of any payments will be issued.
15. Property Loss of Renter: Owner shall not be liable for damage to Renter’s property of any type, for any reason or any cause whatsoever.
16. Indemnification: Renter releases Owner from liability for and agrees to indemnify Owner against (a) any losses, incurred by Owner as a result of Renter’s failure to fulfill any condition of this agreement; (b) any damage or injury happening in or about the rental property to Renter’s invitees or licensees or guests or such person’s property; (c) Renter’s failure to comply with any requirements imposed by any government authority; and (d) any judgment, lien, or other encumbrance filed against renter as a result of Renter’s action.
17. Entire Agreement: This agreement and the associated Rental Property Rules , Procedures and Checklists constitute the entire agreement between the parties and no oral statements shall be binding. It is the intention of the parties herein that if any terms of the rental agreement or the associated rules and/or the procedures is invalid, for any reason, such invalidity shall not void the remainder of the rental agreement or the associated rules and/or procedures.
18. Failure of Owner to Act: Failure of Owner to insist upon compliance with any term of this agreement or associated rules and/or procedures shall not constitute a waiver of any violation.
19. Payment: You agree to pay all fees invoiced to you with respect to the rental of the rental property. The Rental Fees, Security/Damage amount, Cleaning fees and any additional invoiced amounts must be paid in full upon check-in (less all prepayments) is set forth in the associated Vacation Rental Summary Invoice. You also agree to pay additional fees that may be assessed as set forth in this rental agreement and in the attached Rental Rules and Policies.
20. Agreement: By making the security/damage deposit payment for your reservation, you are specifically agreeing to the terms of this rental agreement and the associated rules and/or procedures.
21. TERMINATION: IF RENTER OR ANY OF RENTER’S GUESTS VIOLATE ANY OF THE TERMS OR CONDITIONS OF THIS AGREEMENT, THEN OWNER MAY, AT OWNER’S DSICRETION TERMINATE THE RENTAL WITH NO REFUND MAY ENTER THE RENTAL PROPERTY AND REMOVE RENTER AND RENTER’S GUESTS AND YOUR OR THEIR BELONGINGS. ANY MATERIAL BREACH WILL ENTITLE OWNER TO EXPEDITE EVICTION PROCEDURES. A MATERIAL BREACH SHALL INCLUDE, BUT NOT BE LIMITED TO , DAMAGE TO THE RENTAL PROPERTY OR VIOLATION OF PARAGRAPHS 5, 6, 9 or 14.
Renter acknowledges that he or she has read, understood and agreed to all of the terms and conditions stated in this rental agreement as set forth above and in the associated Rental Rules, Procedures and Checklists.
